I kyrkolagen, kyrkoordningen och lagen om tj\u00e4nsteinnehavare i evangelisk-lutherska kyrkan finns m\u00e5nga formkrav som g\u00e4ller anst\u00e4llning i tj\u00e4nstef\u00f6rh\u00e5llande. I j\u00e4mst\u00e4lldhetslagen och diskrimineringslagen finns dessutom f\u00f6rpliktande best\u00e4mmelser om f\u00f6rbud mot diskriminering vid anst\u00e4llning i tj\u00e4nste- och arbetsavtalsf\u00f6rh\u00e5llande.&nbsp;I \u00f6vrigt finns inga best\u00e4mmelser om anst\u00e4llning i arbetsavtalsf\u00f6rh\u00e5llande.<\/p>\n\n\n\n<p>En tj\u00e4nst inr\u00e4ttas f\u00f6r att sk\u00f6ta vissa best\u00e4mda uppgifter och \u00e4r i kraft tills den dras in. Best\u00e4mmelserna om arbetsavtalsf\u00f6rh\u00e5llanden \u00e4r friare och anst\u00e4llningsf\u00f6rh\u00e5llandet varar endast s\u00e5 l\u00e4nge anst\u00e4llningen fortg\u00e5r. &nbsp;M\u00e5nga f\u00f6rsamlingar iakttar \u00e4nd\u00e5 s\u00e4ttet att anst\u00e4lla i tj\u00e4nstef\u00f6rh\u00e5llande ocks\u00e5 vid anst\u00e4llning i arbetsavtalsf\u00f6rh\u00e5llande \u00e4ven om det inte \u00e4r en skyldighet. Innan tj\u00e4nsten f\u00f6rklaras ledig ska det utredas om till exempel den instruktion som har fastst\u00e4llts f\u00f6r tj\u00e4nsten och den befattningsbeskrivning som gjorts upp f\u00f6r avl\u00f6ningen \u00e4r uppdaterade.<\/p>\n<p>Beslutet om att ledigf\u00f6rklara en tj\u00e4nst fattas i allm\u00e4nhet av kyrkor\u00e5det, f\u00f6rsamlingsr\u00e5det eller, i en kyrklig samf\u00e4llighet, av gemensamma kyrkor\u00e5det. Beh\u00f6righeten att ledigf\u00f6rklara en tj\u00e4nst kan ocks\u00e5 delegeras till ett organ eller till tj\u00e4nsteinnehavare. F\u00f6r att f\u00f6rbereda tills\u00e4ttandet av tj\u00e4nsten bildas i allm\u00e4nhet en urvalsgrupp som kan best\u00e5 av till exempel kyrkoherden, ekonomichefen och chefen f\u00f6r ett eventuellt arbetsomr\u00e5de och dessutom ibland av n\u00e5gon av f\u00f6rsamlingens f\u00f6rtroendevalda. S\u00e5dana \u00e4r:<\/p>\n<ul>\n<li>Arbetsgivare<\/li>\n<li>Tj\u00e4nstens uppgiftsbeteckning<\/li>\n<li>De ovillkorliga beh\u00f6righetsvillkoren f\u00f6r tj\u00e4nsten (examenskrav, eventuellt krav p\u00e5 arbetserfarenhet, krav p\u00e5 medlemskap i kyrkan och krav p\u00e5 spr\u00e5kkunskaper)<\/li>\n<li>Eventuell pr\u00f6votid<\/li>\n<li>Eventuellt uppvisande av straffregisterutdrag<\/li>\n<li>L\u00f6nebelopp eller avl\u00f6ningsgrund<\/li>\n<li>Uppgifter om vart ans\u00f6kan ska skickas, n\u00e4r ans\u00f6kningstiden g\u00e5r ut och vem som ger n\u00e4rmare information om tj\u00e4nsten<\/li>\n<\/ul>\n<p>De ovillkorliga beh\u00f6righetskraven (\u201dav den s\u00f6kande f\u00f6ruts\u00e4tts\u201d) ska s\u00e4rskiljas fr\u00e5n de egenskaper man \u00f6nskar att den s\u00f6kande har (\u201dr\u00e4knas som merit\u201d), vilka inte \u00e4r ovillkorliga beh\u00f6righetskrav. Till exempel arbetserfarenhet kan antingen vara ett ovillkorligt beh\u00f6righetskrav eller en \u00f6nskv\u00e4rd egenskap som beaktas n\u00e4r tj\u00e4nstens tills\u00e4tts. P\u00e5 s\u00e5 s\u00e4tt s\u00e4kerst\u00e4ller man att beslutsfattarna har tillr\u00e4ckligt med information om de s\u00f6kande f\u00f6r att kunna fatta beslut. F\u00f6rteckningen \u00f6ver s\u00f6kande ska inneh\u00e5lla deras namn, utbildning, viktigaste arbetserfarenhet och f\u00f6rtroendeuppdrag som eventuellt p\u00e5verkar valet. I detta skede konstateras vilka s\u00f6kande som uppfyller beh\u00f6righetskraven och vilka som inte g\u00f6r det, samt vilka ans\u00f6kningar som kommit in f\u00f6r sent.<\/p>\n<p>Urvalsgruppen g\u00f6r intervjuerna. Med tanke p\u00e5 olika akt\u00f6rers roller kan det inte rekommenderas att hela kyrkor\u00e5det intervjuar de s\u00f6kande. Kyrkor\u00e5det har i uppgift att besluta vem som ska v\u00e4ljas. En intervju \u00e4r inte obligatorisk men det \u00e4r ett bra s\u00e4tt att f\u00e5 n\u00e4rmare uppgifter om de intressantaste s\u00f6kandena.<\/p>\n<p>Under intervjun kan man endast st\u00e4lla fr\u00e5gor som p\u00e5verkar arbetet, inte om de s\u00f6kandes privatliv. Urvalsgruppen kan skriva ett utl\u00e5tande med sin egen uppfattning om de s\u00f6kande men den egentliga f\u00f6redragningen och beslutsf\u00f6rslaget till det beslutande organet l\u00e4ggs fram av den tj\u00e4nsteinnehavare i vars uppgifter detta ing\u00e5r.\u00a0Att skriva f\u00f6redragningen \u00e4r ut\u00f6ver platsannonsen en annan kritisk fas i anst\u00e4llningsprocessen. F\u00f6redragningen ska g\u00f6ras omsorgsfullt och den ska vara skriftlig. Av den ska framg\u00e5 f\u00f6ljande<\/p>\n<ul>\n<li>Ans\u00f6kningsprocessens f\u00f6rlopp\u00a0(tills\u00e4ttande av urvalsgrupp, platsannonsens inneh\u00e5ll, ans\u00f6kningstid, antal ans\u00f6kningar, ans\u00f6kningar som inkommit f\u00f6r sent och obeh\u00f6riga s\u00f6kande samt de s\u00f6kande som kallats till intervju)<\/li>\n<\/ul>\n<ul>\n<li>Beskrivning av de huvuds\u00f6kandes styrkor och omr\u00e5den som beh\u00f6ver utvecklas eller andra utmaningar<\/li>\n<\/ul>\n<p>Det rekommenderas att de huvuds\u00f6kande beskrivs separat och d\u00e4refter i relation till varandra.\u00a0Valet ska motiveras.\u00a0Brister i motiveringarna f\u00f6rsvagar urvalsbeslutet och kan ge upphov till besv\u00e4r.<\/p>\n<p>Om m\u00f6tesdeltagarna \u00e4r eniga om beslutsf\u00f6rslaget konstaterar m\u00f6tesordf\u00f6randen vem som valts. Om enighet inte n\u00e5s ordnas en omr\u00f6stning. Omr\u00f6stningen kan ocks\u00e5 genomf\u00f6ras med slutna sedlar. H\u00e4r b\u00f6r man beakta att omr\u00f6stningsresultatet inte befriar arbetsgivaren fr\u00e5n p\u00e5st\u00e5enden om diskriminering.<\/p>\n<p>Den som valts och \u00f6vriga s\u00f6kande informeras om valet. Den som valts f\u00f6r tj\u00e4nsten f\u00e5r ett utdrag ur protokollet men inget s\u00e4rskilt \u201dtj\u00e4nsteavtal\u201d ing\u00e5s. Det \u00e4r obligatoriskt att ge anvisningar om hur man beg\u00e4r ompr\u00f6vning eller en besv\u00e4rsanvisning, och ompr\u00f6vnings- eller besv\u00e4rstiden b\u00f6rjar l\u00f6pa fr\u00e5n delgivandet.
